Please read these Terms and Conditions ("Terms") carefully before using Diamond Bros & Co. websites or purchasing our products and services. By accessing our websites, making a purchase, or submitting a consultation request, you agree to be bound by these Terms and our Privacy Policy.

1. About Diamond Bros & Co.

Diamond Bros & Co. is a luxury diamond jewelry business operated by Diamond 2 Brothers Co Corp., a corporation registered in the Province of Ontario, Canada. We operate two showroom locations in Mississauga, Ontario, and provide in-person and virtual private consultations to customers across Canada and the United States.

2. Acceptance of Terms

By accessing our websites, making a purchase, booking a consultation, or submitting any form on our websites, you agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree with any part of these Terms, please do not use our websites or services.

These Terms may be updated at any time. Continued use of our websites or services after updates constitutes acceptance of the revised Terms.

3. Products and Purchases

3.1 Product Descriptions

• All diamonds sold by Diamond Bros & Co. are accompanied by independent GIA (Gemological Institute of America) certification unless otherwise disclosed
• Product images, descriptions, and 3D design previews are for illustrative purposes and may vary slightly from the finished product
• Diamond Bros & Co. reserves the right to correct errors in product descriptions or pricing at any time

3.2 Pricing

• All prices are in Canadian Dollars (CAD) unless otherwise stated
• Prices are subject to applicable taxes
• Prices are subject to change without notice
• Price comparisons made on our websites between Diamond Bros pricing and other retailers are estimates based on publicly available market data and are provided for informational purposes only

3.3 Custom Orders

• Custom jewelry orders are subject to a separate written purchase agreement and deposit requirements
• Custom orders are non-refundable once production has begun, except as required by applicable law
• Production timelines are estimates and may vary due to design complexity, material availability, and other factors
• Diamond Bros & Co. reserves the right to substitute diamonds of equivalent grade and value with customer notification if the originally selected stone becomes unavailable

3.4 Returns and Exchanges

4. Free Private VIP Consultation

4.1 Nature of the Consultation

Diamond Bros & Co. offers a complimentary 60-minute Private VIP Diamond Consultation. This consultation is completely free with no purchase obligation, private and conducted one-on-one, and includes a custom ring design preview, GIA diamond education, and wholesale pricing comparison. It does not constitute a binding purchase agreement.

4.2 Booking and Cancellation

• Consultation slots are limited and subject to availability
• You may cancel or reschedule at any time by calling (647) 860-2767 or emailing info@diamondbros.co
• We request at least 24 hours notice for cancellations where possible
• Diamond Bros & Co. reserves the right to reschedule consultations with reasonable notice

5. Communications Consent

5.1 SMS Text Messages

By providing your phone number and checking the consent checkbox on our consultation forms, you provide prior express written consent to receive automated SMS text messages from Diamond Bros & Co. including appointment confirmations, reminders, follow-up messages, pre-call notifications, and marketing messages. Message and data rates may apply. Maximum frequency is 3 messages per 7-day period.

5.2 Artificial Intelligence (AI) Voice Calls

By submitting your phone number and consenting on our form, you expressly agree to receive automated outbound calls, pre-recorded messages, and calls using artificial intelligence (AI) voice technology from Diamond Bros & Co. All AI-initiated calls identify themselves as automated and identify Diamond Bros & Co. as the calling business at the start of each call, in compliance with FCC rules and applicable state regulations.

5.3 WhatsApp Video Calls

For virtual consultations, Diamond Bros & Co. conducts appointments via WhatsApp video call from +1 437-800-0786. By booking a virtual consultation, you consent to receive WhatsApp video calls and messages from this number. You must have WhatsApp installed and a verified account to participate.

5.4 Email Communications

By providing your email address, you consent to receive transactional emails including order confirmations, shipping updates, appointment confirmations, and reminders. Marketing emails require your consent and include an unsubscribe link in compliance with CASL and CAN-SPAM.

5.5 Telecommunications Compliance

Diamond Bros & Co. complies with the Telephone Consumer Protection Act (TCPA), FCC rules including the one-to-one consent rule (January 27, 2025), Canada's Anti-Spam Legislation (CASL), Texas SB 140 (September 2025), California CCPA/CPRA, and all applicable provincial and state telecommunications regulations.

6. Virtual Consultations

6.1 Technical Requirements

To participate in a virtual consultation, you must have a device with a working camera and microphone, WhatsApp installed and a verified account, a stable internet connection, and have saved our WhatsApp number (+1 437-800-0786) before the appointment.

6.2 Limitations

Diamond Bros & Co. is not responsible for technical difficulties caused by your internet connection, device, or WhatsApp service disruptions. Virtual consultations may have limitations compared to in-person consultations, including the inability to physically handle diamonds and rings.

7. Virtual Consultation Flight Benefit Offer

This section applies exclusively to the virtual consultation offer available at virtual.diamondbros.co.

7.1 Offer Description

Diamond Bros & Co. may offer a flight reimbursement benefit to qualifying customers who purchase diamond jewelry meeting the minimum qualifying purchase threshold stated on the website at the time of booking (currently CAD $5,000 or more) and complete their purchase in person at a Mississauga showroom.

7.2 Eligibility Requirements

• Initial booking must have been made through virtual.diamondbros.co
• Purchase must meet the minimum qualifying threshold at time of booking
• Purchase must be completed in person at a Diamond Bros & Co. Mississauga showroom
• Reimbursement applies to economy class round-trip airfare only, from the customer's city of origin to Toronto Pearson (YYZ) or Billy Bishop (YTZ) airport
• Reimbursement is for one passenger only
• Travel must occur within the offer validity period
• Original flight receipts or booking confirmations must be submitted
• Reimbursement is processed after purchase completion and receipt verification

7.3 Exclusions and Limitations

• Reimbursement does not cover hotel, ground transportation, meals, baggage fees, or any expense other than base economy airfare
• Maximum reimbursement amount is at Diamond Bros & Co.'s sole discretion and will be communicated in writing before purchase
• This offer cannot be combined with any other promotion or discount
• Diamond Bros & Co. reserves the right to modify, suspend, or discontinue this offer at any time. Customers who have already made a qualifying purchase before any change will be honored.
• This offer has no cash value and is non-transferable

8. Intellectual Property

All content on our websites including text, images, logos, ring designs, graphics, and 3D renderings is the property of Diamond 2 Brothers Co Corp. or its licensors and is protected by Canadian and international copyright laws. You may not reproduce, distribute, or create derivative works from any website content without prior written consent. Custom ring designs created during a consultation transfer to the customer as part of the purchased product upon full payment.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Diamond Bros & Co., Diamond 2 Brothers Co Corp., and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim shall not exceed the amount paid by you to Diamond Bros & Co. in the 12 months preceding the claim. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

10. Indemnification

You agree to indemnify and hold harmless Diamond Bros & Co., Diamond 2 Brothers Co Corp., and their respective officers, directors, employees, and agents from any claims, damages, costs, and expenses (including legal fees) arising from your use of our services, violation of these Terms, violation of applicable law, or provision of inaccurate information.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. For US residents, applicable mandatory consumer protection laws of your state of residence may also apply and nothing in these Terms limits those rights.

12. Privacy

Our Privacy Policy governs the collection, use, and disclosure of your personal information and is incorporated into these Terms by reference. By using our services, you also agree to our Privacy Policy available at diamondbros.co/pages/privacy-policy.

13. Force Majeure

Diamond Bros & Co. shall not be liable for delay or failure to perform due to circumstances beyond our reasonable control, including natural disasters, pandemic, government action, supply chain disruptions, or other force majeure events.

14. Severability

If any provision of these Terms is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable. The remaining provisions shall continue in full force.

15. Entire Agreement

These Terms, together with our Privacy Policy and any written purchase agreements, constitute the entire agreement between you and Diamond Bros & Co. regarding use of our websites and services.
